Terms of Service

1. Agreement

By creating an account or using gumshoe.au (the "Service"), you agree to these Terms and to our Privacy Policy. If you use the Service on behalf of an organisation, you confirm you're authorised to bind it.

2. What Gumshoe does

Gumshoe provides supplier-verification searches and reports drawn from public registers (ABR, ASIC) and other public signals, ending in an assurance rating. Some checks are free; certain premium checks (currently a Street View location classification and a recorded Phone verification) are charged per use.

3. Not advice; accuracy

Gumshoe is a due-diligence tool, not a guarantee. Results are compiled from third-party and public data that may be incomplete, out of date, or wrong, and an assurance rating is an aid to your judgement — not a certification of a supplier's legitimacy, creditworthiness, or honesty. You remain responsible for your own decisions about whom to pay or do business with. Gumshoe does not provide legal, financial, or accounting advice.

4. Acceptable use

You agree to use the Service only for legitimate business due-diligence. You must not: use it to harass, stalk, or unlawfully profile individuals; scrape, resell, or bulk-extract the underlying data; attempt to break or overload the Service; or use verification calls for any purpose other than good-faith supplier confirmation. Sole-trader records may contain personal information — handle results accordingly and in line with the Privacy Act.

5. Premium checks, payment and recorded calls

Premium checks are charged at the prices shown at the time you run them. By running a Phone check you authorise Gumshoe to place an automated, recorded call to the supplier's publicly listed number with an audible recording disclosure; you confirm you have a legitimate basis for the verification. Paid checks are consumed when run and are generally non-refundable once results are delivered, except as required by the Australian Consumer Law.

6. Accounts

You're responsible for activity under your account and for keeping your password secure. Notify us of any unauthorised use.

7. Availability

We aim for high availability but don't guarantee the Service will be uninterrupted or error-free, and we may change or suspend features.

8. Liability

To the maximum extent permitted by law, Gumshoe is not liable for indirect or consequential loss, or for loss arising from your reliance on verification results. Nothing in these Terms excludes rights you have under the Australian Consumer Law; where our liability can't be excluded, it is limited (at our option) to re-supplying the relevant check or refunding its price.

9. Intellectual property

The Service, its design, and its reports (excluding the underlying government data, which is CC BY 3.0 AU) are owned by Gumshoe. You may use reports for your own business records and audit purposes.

10. Termination

You may close your account at any time. We may suspend or terminate access for breach of these Terms.

11. Governing law

These Terms are governed by the laws of Victoria, Australia, and you submit to the courts of that jurisdiction.
